Preliminary Requirements:

  • Present in the U.S. without admission or parole.
  • Continuously present in the U.S. since:
            - June 17, 2014 (spouse of U.S. citizen), or
            - June 17, 2024 (stepchild of U.S. citizen).
  • Legally married to a U.S. citizen as of June 17, 2024.
  • No disqualifying criminal history.
  • No threat to national security or public safety.

Evidence

Identity:

  • Driver’s license, passport identity page, national identity card, or any other official identity document.
  • Relationship:

  • Marriage certificate or birth certificate.

Physical Presence

  • DHS or INS document evidencing your entry.
  • Rent receipts, utility bills, etc.
  • School records.
  • Hospital or medical records.
  • Official records from a religious entity.
  • Any other documents related to your presence in the U.S.

  • Please note that this relief is discretionary and subject to review by the USCIS. As such, even if you meet all of the above requirements, there is no guarantee you will be granted Parole in Place.

    What is Parole in Place?

    Spousal parole in place is a new program where certain spouses and step- children of U.S. citizens can qualify for parole in the United States, if they meet certain requirements. Once they get parole, they can then adjust their status to get a green card from within the United States (without having to leave the country).

    What are the requirements for Spousal Parole in Place? To be considered for Spousal Parole in Place, an individual must:

    • Be present in the United States without admission or parole;
    • Have been continuously present in the United States for at least 10 years as of June 17, 2024;
    • Have a legally valid marriage to a U.S. citizen as of June 17, 2024;
    • Must not have disqualifying criminal history or otherwise constitute a threat to national security or public safety; and
    • Should otherwise merit a favorable exercise of discretion.
