On July 3, 2013, The Supreme Court struck down an integral part (Section 3) of DOMA (Defense of Marriage Act). As a result, same-sex couples who are legally married will obtain equal rights to the benefits under federal law. IMPORTANTLY, this includes immigration benefits and these benefits, as per Janet Napolitano (Secretary of Homeland Security), will be available immediately.
**I-601A, Application for Provisional Unlawful Presence Waiver**
The USCIS will start accepting Form I-601A, Application for Provisional Unlawful Presence Waiver on March 4, 2013. You may qualify for this waiver if you have a qualifying relative (parent or spouse) that is a United States citizen and your only ground of inadmissibility is unlawful presence.
